The penalties handed out to two individuals who committed the same crime was contingent on the caste of the perpetrators. The lower castes were subject to strict punishment. This law-making procedure was gradually altered during the colonial era.

However , this belief is challenged by various historians because they considered the colonial laws to be arbitrarily drafted and that the Indian nationalists played a significant part in establishing the law of the land within British India.
