Who is Responsible for providing information?

* Appropriate Government

* public authority

* competent authority 

 

Appropriate Government-

"Appropriate Government", in relation to a public authority, means—

 

* Organizations established, constituted, owned, controlled, or fully financed by funds provided directly or indirectly by the Central Government or Union territory.

* Organizations established, constituted, owned, controlled, or fully financed by funds provided directly or indirectly by the State Government.

 

Public Authority-

Public authority means any authority or body or autonomous government body established by or under the Constitution, by any other law made by Parliament, by any other law made by the State Legislature, by notification or order issued by the appropriate Government,  or be constituted.

 

Competent Authority-

Competent Authority means-

 

* Speaker of Lok Sabha and State Legislative Assembly and Chairman of Rajya Sabha or State Legislative Council

* Chief Justice of the High Court in the case of the Supreme Court,

* In the case of other authorities established or constituted by or under the Constitution, the President or the  Governor

* Administrator appointed under Article 239 of the Constitution

 

 

Appeal on non-receipt of information within the time limit -

* If a person does not receive the information within the time limit, he may prefer an appeal to an officer who is senior to the rank of a Public Information Officer in every public authority.

* The second appeal shall lie to the Central Information Commission or the State Information Commission within ninety days from the date of the decision of the first appeal.

 

Penalties-

 

When, in the opinion of the Central Information Commission and the State Information Commission, any Central Public Information  Officer or State Information Officer refuses to accept the application without any necessary reason or willfully gives false, incomplete, or misleading information; or has destroyed such notice, a penalty of two hundred and fifty rupees shall be imposed for each day till the application is received or the notice is given,  and the total amount shall not exceed twenty-five thousand rupees. There is also a provision for the recommendation of disciplinary action under the applicable service rules in certain cases.
