Chief Minister and Council of Ministers

  • According to Article 163 , there shall be a Council of Ministers to aid and advise the Governor, with the Chief Minister as its head.
  • According to Article 164 , the Governor appoints the leader of the majority party in the Legislative Assembly as the Chief Minister. And then on the advice of the Chief Minister appoints other ministers as well. The Chief Minister is the de facto head of the state executive and the elected head of the state.

  • By the 91st Constitutional Amendment 2003 , Article 164 provides that the number of members in the Council of Ministers should not exceed 15% of the total strength of the lower house (Lok Sabha and Rajya Sabha) but the number of ministers including the Chief Minister in a state. The total number shall not be less than 12 .

 

Qualifications of Chief Minister and other Ministers

  • The provisions relating to ministers and leaders in the Constitution are given in Article 164(4) . In which it has been said that a minister who  is not a member of the state legislature for 6 consecutive months will cease to be a minister at the end of this period.

Oath by Chief Minister and Ministers

  • Before a minister enters upon his office, the Governor administers to him the oath of secrecy to perform the duties of his office in accordance with the drafts given in the Third Schedule of the Constitution.

  • There are three categories of ministers in the state council of ministers, cabinet ministers (members of cabinet) ministers of state and independent charge.
  • Cabinet ministers are the most important ministers because the policy of governance is decided collectively by the cabinet itself. At the second level are the ministers of state who assist in the work of the cabinet minister.
  • In the third category, there are ministers of state (independent charge)  who handle the responsibility of a department independently, not under any cabinet minister.
  • In Madhya Pradesh, there is a special provision for the appointment of a Tribal Welfare Minister by the Governor on the advice of the Chief Minister.

  • The allowances of the Chief Minister and other ministers are determined by the State Legislature Legislative Assembly from time to time. But according to Article 164(5) , until the State Legislature makes provision in this regard, the salary and allowances of the Ministers shall be as per the provisions made in the Second Schedule.

  • Usually the term of the Council of Ministers is years , but after having its majority in the Legislative Assembly, the Council of Ministers can be dissolved before its fixed term . 
  • According to Article 365 , when President's rule is imposed in the state, the Council of Ministers is dissolved.
  • The Council of Ministers can also be dissolved by the Governor on the request of the Chief Minister.

 

Functions and Powers of Chief Minister

  • The Chief Minister acts as a link between the Governor and the Council of Ministers.   It is the duty of the Chief Minister to inform the Governor about the decisions taken by the Mandi Parishad on matters related to the administration and legislation of the State .
  • The Chief Minister advises the Governor in relation to the appointment of office bearers of the State such as the Advocate General , the Chairman of the State Public Service Commission and the Member State Election Commissioner etc. Is.
  • The Chief Minister distributes and changes the portfolios of his ministers and in case of difference of opinion, can ask any minister to resign or advise the Governor to dismiss him.
  • The Chief Minister presides over the meeting of the Council of Ministers and the Legislature and he gives cooperation directions and guidance to all the ministers in their work as well as controls their work.

 

Specific facts about Chief Minister

  • The first Chief Minister of Madhya Pradesh was Pandit Ravi Shankar Shukla and the first woman Chief Minister was Ms. Uma Bharti. 
  • The shortest tenure as Chief Minister was day of Shri Arjun Singh and 13 days of Shri Raja Harishchandra Singh, who was the first tribal Chief Minister of the State.
  • During the tenure of Chief Minister Arjun Singh, Bhopal gas tragedy in the year 1984 and the incident of surrender of female dacoit Phoolan Devi took place.

  • Presently there are 10 divisions, 52 districts, 313 development blocks and 420 tehsils in Madhya Pradesh.

  • In the year 1998, 10 districts were formed on the recommendation of BR Dubey Committee and 6 districts were formed on the recommendation of Singhdeo Committee.
  • Shahdol division was formed on 14 June 2008 and Narmada Kora division on 27 August 2008.
  • In Madhya Pradesh, the formation of Satpura intercourse as 11th division and Ratlam division of 12th division is proposed.
  • Dindori district was included under Shahdol division in the year 2008 but in the year 2012 it has been included in Jabalpur division.
